Terms and conditions
TERMS AND CONDITIONS BETWEEN THE USER AND STARCKS
If you want the short version, here are the main points of our terms and conditions
1. What we do on the platform
Starcks' business consists of selling Star Tokens (STK) and Star Player Tokens (SPT) to users of the platform.
The Star Token is a digital asset similar to a non-refundable multi-purpose voucher that allows you to purchase services and content offered on the platform, including SPTs.
Star Player Tokens are unique digital assets that represent the possibility of using official player statistics in the game 'Starcks The Game'. They do not represent ownership or exploitation rights of sports data, but are digital items for internal use necessary for participation in the platform's fantasy football.
The value of SPTs remains linked to the Star Token and subject to standard VAT at 22%.
2. Commissions and Refunds
Both Star Tokens and Star Player Tokens can be exchanged between users using the tools provided by Starcks.
We charge the following fees for the service:
- Deposit: 0%
- STK and STP Market Purchase: 1% Limit 0%
- Sale STK and STP Market: 1% Limit 0%
- Withdrawal: 4% + 1 euro
The only case in which a refund is possible, minus withdrawal fees, is when the euro amounts held on Starcks that have not yet been used to purchase STK or STP are returned in the event of account closure.
3. We are not a virtual currency exchange operator as defined by law
In other words, we are not Binance, Kraken or Young Platform. We do not list or allow the exchange of cryptocurrencies such as ETH, BTC, BCH and similar or stablecoins on our platform and do not plan to do so in the future.
All exchange mechanisms are internal and focused on STK and SPT, which are not cryptocurrencies (see point 1).
Please note. The legislation is currently new and there are no precedents to clarify whether there are specific obligations with regard to this activity. In any case, Starcks maintains adequate AML and KYC standards, even though this is not required for this type of activity.
4. Star Token and Star Player Token
The Star Token (STK) is a multi-purpose digital voucher that allows access to the services and goods offered by the platform.
The Star Player Token (SPT) is a digital item that grants the limited right to use player statistics exclusively in the Starcks The Game.
It does not represent a licence to use the data outside the system, nor a property or investment right.
The data used to power the game mechanics comes from Sportmonks, which has authorised its use for gaming purposes. Player information, such as names and statistics, is in the public domain, while images and trademarks remain the property of their respective owners.
5. STK and STP are not investment products
Please note that none of the products sold on the platform can be considered an investment.
In any case, in order to protect users and its own business, Starcks has chosen to implement Anti-Money Laundering (AML) and User Profiling (KYC) measures in order to comply with current legislation.
6. Rewards and badges
The Platform may offer rewards linked to your activity, such as the reward for accessing the Platform on consecutive days (the “Daily Streak”). These rewards are granted in Credits and, like all our bonuses, are intended to be used within the game on the Platform.
Badges are purely aesthetic elements displayed on your profile. They have no economic value, cannot be transferred or sold and do not confer any advantage in the game.
7. Retired players and Legend Tokens
When a footballer associated with an SPT officially retires from professional football, the related SPTs are reclassified as “Legend Tokens”. Legend Tokens can no longer be fielded as regular players in Starcks The Game and no longer generate performance scores; they remain tradable on the platform and grant access to dedicated features, such as the Legend Slot in the Game and dedicated Locking options, as defined in the official Game rules. The reclassification of an SPT as a Legend Token does not entitle the holder to any refund, conversion or compensation.

Art. 2 – SUBJECT MATTER
These general terms and conditions of service (hereinafter also referred to as "General Terms and Conditions" or "Terms and Conditions") govern the terms and conditions under which Starcks S.r.l., as owner of the Platform, will perform the Service.
In performing the Service offered to the User, Starcks undertakes to make the Platform available to the User so that Token Holders can purchase, sell and exchange Tokens and digital goods and services, as well as participate in games, subject to the relevant regulations, offered therein and obtain Star Credits and Perks.
Specifically, Starcks, through its Platform, offers Users the following activities:
- creation of a personal User profile with which it will be possible to access and operate on the Platform (the "Account");
- access – through the use of the Account and personal credentials generated – to an area reserved for the User ("Reserved Area") where they can monitor the content and performance of their Wallet, as well as manage their personal information;
- issuance of STs and SPTs, which Starcks will sell directly to users following issuance and which can then be traded on the Platform;
- use of a proprietary algorithm which – in combination with the Performance Card – will be used to regulate the phenomenon of SPT Burn and SPT Emission, thus generating an increase or decrease in the number of Tokens in circulation;
- making available the Starcks Marketplace, present on the Platform, where Token Holders will be able to spend their Tokens or Star Credits to obtain Perks, consisting of items, memorabilia and experiences to be enjoyed with other players or accessories necessary to participate in the game.
With the performance of the services described above, and specifically with the delivery of STs and SPTs to users through the distribution and exchange mechanisms, the Company's obligations are duly fulfilled and the User may not make any further claims against the Company. Starcks is not and cannot be held responsible for any changes in value with respect to the Tokens issued, which are digital assets by nature and, in any case, by agreement between the parties, are not and will not be refundable by the Company in any way.
In this sense, SPTs are digital assets that can only be used to access the platform's gaming features. They do not constitute the transfer or resale of data from the Data Provider, but a regulated and limited right of use within the Starcks ecosystem, expressly permitted by the Data Provider itself.
Art. 3 – METHOD OF EXECUTION
The Company makes these General Terms and Conditions of Service available to the User for review; by ticking the 'Terms and Conditions' box on the Platform as a necessary condition for completing the User's registration ('Registration'), the User declares that they are of legal age and are aware of, have read and fully accept and agree to these Terms and Conditions.
Once the Registration procedure has been completed, Starcks undertakes to provide the User with all the services described in Article 2 of this agreement, including, but not limited to:
- the KYC & AML procedures, which Starcks implements to protect users in the event that they wish to convert STs into decentralised utility cryptographic tokens;
- the possibility to purchase and exchange ST by accessing the exchange mechanism provided on the Platform;
- the possibility of converting money into Tokens and vice versa;
- access to the User's Personal Area on the Platform;
- a personal Wallet;
- an area where it is possible to view the SPTs purchased and exchanged;
- participation in the game made available by Starcks subject to the relevant regulations;
- the possibility to participate in Locking activities made available by the Platform;
- access to the Starcks Marketplace, where the available Perks and their relative cost, expressed in Star Credits or ST, will be indicated;
- more generally, all services associated with those expressly mentioned.
In the case of purchase of Tokens offered on the Platform, Starcks reserves a maximum period of 60 (sixty) minutes from the time of payment execution for their loading and deposit.
The activities referred to in Article 3.2 above will only be possible for the User on condition that they complete the KYC&AML activities required by the Platform, in full compliance with the requirements of the sector regulations on combating terrorism and money laundering.
The Company is currently registered in the special register kept by the OAM (Organismo degli Agenti e Mediatori creditizi - Organisation of Credit Agents and Brokers) and is awaiting authorisation to trade cryptocurrencies again in accordance with the new MICAR regulations. At present, therefore, the conversion mechanism into Cryptographic Tokens is to be considered disabled until further notice from the Authority.
The User declares that they are fully aware that the ST is a digital asset and, if converted, a token proving the purchase of the asset on the Starcks platform, the characteristics of which are fully explained in the Whitepaper made available by the Company on the Platform, the content of which is hereby reproduced in full.
Accordingly, the User is aware (i) that the Tokens on the Platform do not in any way constitute a financial instrument, security, or any other form of investment recognised as such by our jurisdiction (ii) that they are Digital Assets and therefore Digital Goods and that the Company's typical activity consists exclusively in their sale.
In the event that any of the documents provided during registration on the Platform or any of the payment instruments registered therein expire, the User will receive a notice from the Platform and the ability to make withdrawals from the Platform will be temporarily disabled until the necessary documentation is updated.
In particular, the User undertakes to the Company not to:
- use the Platform in a way that causes or may cause damage to it or may compromise its performance, availability or accessibility, and not to exploit any bugs or errors in any way in order to gain an undue advantage;
- grant access to their Account, Personal Area and/or other features of the Platform to third parties;
- violate applicable laws or simulate purchase negotiations and/or use automated systems of any kind on the Platform and/or engage in unfair commercial conduct;
- participate in Referral Programmes in an improper manner and/or contrary to the law, these Terms and Conditions, and/or the purpose for which they were designed, or with the intent to circumvent the limits imposed by the Company for their redemption in the relevant regulations;
- induce third parties to engage in activities in violation of these Terms and Conditions, its Annexes and/or the Law;
- use the Platform in a manner contrary to these Terms and Conditions or in an unlawful, illegal, fraudulent or harmful manner or in connection with any purpose or activity that is unlawful, illegal or fraudulent;
- use the Platform to copy, store, host, transmit, send, use, publish or distribute any material consisting of, or linked to, computer viruses, spyware, Trojan horses, worms, keystroke loggers, rootkits or any other malicious software;
- conduct any systematic or automated data collection activity concerning or in connection with the Platform without the express written consent of Starcks, except for collection operations provided for by the use of APIs;
- access or otherwise interact with the Platform using robots, spiders or other automated means;
- circumvent, bypass, or attempt to bypass security, KYC, and AML procedures, or any access restrictions on the Platform itself;
- perform actions that may cause an unreasonable overload on the Company's technological infrastructure and that may interfere with the proper use of the Platform by Users;
- alter, modify or distribute to third parties any material on the Platform.
Art. 3.1 – Fees
In order to guarantee the use of the platform and for services consisting of purchasing and selling activities by both Starcks and other users of SPTs and STs, Starcks may apply a fee for the provision of such services ("Commissions"), currently set as follows:
- Deposit: 0%
- EUR – ST exchange: 0% Limit | Market 1%
- ST – SPT exchange: 0% Limit | Market 1%
- Withdrawal: 4% + 1 euro
Art. 4 – PAYMENT METHODS
Any payment by the User or Token Holder to the Company shall be made through the payment services integrated into the Platform.
Payments made by the User or Token Holder shall be made by credit card or IBAN, which shall then be subject to the necessary checks during the completion of the KYC & AML procedure.
Art. 5 – WITHDRAWAL PROCEDURE
Once registration on the Platform has been completed, the User will be able to access the section dedicated to the Wallet in the Personal Area. In order to operate on the Platform, the balance of this Wallet must always be positive and, in order to proceed with the withdrawal of the amount present therein (the "Withdrawal"), a sum of at least €45.00 (forty-five/00) must be deposited. The provisions of this point shall not apply if the User intends to request the withdrawal of cryptocurrencies deposited in their Wallet.
If the User wishes to proceed with the Withdrawal, they may submit the relevant request to the Company via the Personal Area and, from that moment, Starcks reserves a period of at least 6 (six) days for the approval and processing of the request (the "Request Processing Time").
From the moment the request is processed and fulfilled, in order for the Withdrawal to be completed – and, therefore, for the requested amounts to be credited – the User must wait for the ordinary crediting times required and provided for by the banking institutions involved.
Please note that after completing the Registration procedure, the User will be able to request and make a Withdrawal starting from midnight of the following day (00:00 hours of the following day).
In the event of Starcks activating referral programmes, the terms and conditions indicated above for carrying out the Withdrawal Procedure may be subject to temporary changes, which will in any case be duly explained to Users in the regulations made available on the Platform, as well as accepted by them, and which will only involve the possibility of withdrawing the amounts obtained by participating in such programmes.
Art. 6 – REFUND REFUSAL
Under no circumstances will Starcks grant Token Holders any right to a refund on Tokens and SPTs purchased on the Platform.
Accordingly, the User hereby accepts that, once purchased, the Tokens on the Platform will not be refundable in any way and under any circumstances and, if the User intends to remove them from their Wallet, they may convert them into cash if there is a demand for purchase.
Art. 6.1 – STAR RETIREMENT AND LEGEND TOKENS
Upon the Retirement of a Star, the SPTs associated with that Star are automatically reclassified as Legend Tokens with effect from the date announced by the Company through its official channels.
As of the effective date of the reclassification: (i) the Legend Token can no longer be fielded as a regular player in Starcks The Game; (ii) no Performance Card is generated for the retired Star and, accordingly, no SPT Burn or SPT Emission events occur in relation to the Legend Token; (iii) the Legend Token remains a digital asset tradable between Users on the Platform under the same conditions applicable to SPTs.
Legend Tokens grant their holders access to dedicated features made available by the Company, which may include: (a) the “Legend Slot”, an in-Game feature governed by the official Game rules, whereby holding a minimum countervalue of Legend Tokens enables an additional effect within the User's formation; and (b) dedicated Locking options. The functional parameters of such features (including minimum thresholds, multipliers and rates) are defined in the official Game rules and on the Platform, and may be introduced, amended or discontinued by the Company in accordance with Article 15.
The reclassification of an SPT as a Legend Token does not constitute an event entitling the Token Holder to any refund, conversion, buyback or compensation of any kind, in accordance with Article 6. The market price of Legend Tokens is determined exclusively by supply and demand between Users, and the Company gives no warranty as to the retention of any value following Retirement.
Art. 7 – WARRANTIES AND DISCLAIMER
By accepting these General Terms and Conditions, the User hereby declares that they are fully aware of the risks associated with the use of the Platform and the activities carried out therein, as indicated in the Whitepaper on the Website and in the App, the content of which is hereby fully reproduced and accepted.
In any case, the Company shall not be held liable in any way, and makes no warranty in this regard, for any consequences arising from the following main risk factors:
- depending on user demand over time, the market price of the Tokens available on the Platform may vary, which could result in losses for Token Holders, even up to the entire amount spent on the purchase of the Tokens themselves; due to this risk, the Company warns Users that the activity in question is reserved only for individuals who have sufficient financial resources to bear any losses that may arise;
- it is possible that, over time, there may be limited interest in the use of the ST, SPT and/or the Platform on the market, and this could have a negative impact on the development of the Platform. To this end, the User expressly accepts that the Company's main obligation towards them is not to facilitate trading between Token Holders of the Tokens in their possession, and therefore the Company will not intervene in any way in the trading activity that may take place on the Platform;
- the main purpose of the activity carried out on the Platform is not to facilitate the exchange of Tokens between Token Holders, therefore the Company will not intervene in any way in the trading activity that may take place between private individuals and, depending on this mechanism, there may be a risk of illiquidity with respect to the Tokens in circulation. The Platform consists of open source code that is periodically updated and/or modified, which could generate unexpected, unwanted and negative results on the functioning of the Site, the App, the services offered therein and the Tokens;
- depending on the performance of the Stars to which the SPTs are associated, SPT Burn and SPT Emission events may occur, which could have negative effects on the SPTs held by the User and deposited in the Wallet, whose market price may vary;
- the Retirement of a Star constitutes an inherent risk of the SPTs: following Retirement, the associated SPTs are reclassified as Legend Tokens pursuant to Article 6.1, their use within the Game changes accordingly and their market price may vary significantly, potentially resulting in losses for Token Holders;
- to date, the regulatory framework created by the legislator, both at national and European and international level, is rather incomplete and uncertain and, for this reason, it is difficult to predict whether and how the sector authorities will apply existing regulations and future implementations, as it cannot be ruled out that there will be negative effects on the Tokens and their circulation, requiring, for example, specific authorisations from the authorities for this purpose;
- furthermore, the User and the Token Holder hereby accept all the intrinsic risks of the ST and SPT that may not have been expressly provided for in the Whitepaper, available on the Website, on the App and accepted by the User, or in these Terms and Conditions, such as, for example, the personal risks and liabilities incurred in the event of (1) money laundering; (2) fraud; (3) pursuit of illegal purposes; and (4) any other risk not currently foreseen or foreseeable by the Company for the purchase of Perks on the Platform's Marketplace at the time of termination of the activity;
- request the disposal of the funds deposited in their Wallet in accordance with the provisions of Article 6.2 above.
The Company reserves the right to make changes to the Whitepaper available on the Platform, as well as to these General Terms and Conditions of Service and any other type of public document, without any obligation to give prior notice to third parties – including Token Holders – in order to ensure that the information provided is always up to date and in line with the development of the technology involved, regulations and any risk profiles that may arise. In this case, the provisions of Article 15 below shall apply.
As the Company's primary objective is not to enable the exchange of ST and STP with other cryptographic tokens, it does not guarantee in any way to Users that the STK 3.0 cryptographic and decentralised tokens will subsequently be listed on other Exchangers or DeFy mechanisms. In any case, it undertakes to present the Whitepaper in the manner provided for by the relevant legislation.
The Company reserves the right, and makes no guarantee to the User in this regard, to decide to discontinue its activities and the issuance of Tokens in a given jurisdiction if, in light of the adoption of new local regulatory and legislative provisions, it is no longer convenient to carry out such activities there, it becomes excessively complex to obtain the necessary authorisations and licences, or it even becomes illegal to operate the Platform.
The Company undertakes to do everything possible to ensure that Users have uninterrupted access to the Services and that all data, ST and SPT transmissions are error-free. However, the Company shall in no way be held liable for any malfunction - relating to hardware, software, internet connection and other technologies involved - that causes service interruptions, communication errors, distortions and delays in the operation of the Platform, if this is due to unforeseeable circumstances, force majeure or events beyond its control. Furthermore, access to and use of the Platform may also be occasionally and temporarily suspended and/or limited in order to allow for repair, maintenance and/or the introduction of new activities or services on the Platform.
The User is aware that the tax classification of the Tokens issued on the Platform is currently still uncertain and, for this reason, hereby exempts the Company from any negative consequences that may arise from a tax perspective.
The User is aware that, by purchasing STs and SPTs, the Token Holder does not in any way become the owner of any intellectual property rights, property or any other form of shareholding and, for this reason, all decisions involving the Company and its management – including the decision to cease operations and/or liquidate the Company – will be taken by the Company at its sole discretion, without the Token Holder having any claim against it.
Although the Company has established a rigorous selection process for its commercial partners, it does not guarantee the quality of any third-party products or services that may be made available on the Platform. Consequently, Starcks cannot be held liable for any disruption to the Platform or the provision of the Service by its partners and/or suppliers.
The User is aware that any information or Service provided by Starcks or otherwise present on the Platform may not under any circumstances be considered as an invitation or solicitation to invest.
Under no circumstances shall the Company's failure to exercise its right to take action against Users who fail to comply with one or more obligations under these Terms and Conditions be interpreted or considered as a tacit waiver of the Company's rights, including the right to take legal action to protect its interests.
To this end, it should be noted that tolerance of a total and/or partial breach does not constitute a waiver of the underlying right and, furthermore, the waiver of a single right shall in no case imply a tacit waiver of any other rights, whether different and/or derived from it, provided for in this document.
It should also be noted that if an agreement is declared null and void due to changes in legislation, such nullity shall not affect the validity of the entire underlying contractual relationship, except in cases where the provision that has become null and void is, by its nature, fundamental to the purposes of the Service offered on the Platform.
Starcks uses statistical data provided by the Data Provider under express licence. The User acknowledges that the data and performance of the players used on the platform are derived from third-party sources and that Starcks is not responsible for any inaccuracies, discrepancies or delays in the transmission of information.
Starcks does not use official images, logos or trademarks of players, clubs or football leagues, and does not claim any rights to such content, which remains the property of their respective owners.
Art. 8 – SUSPENSION AND CANCELLATION OF THE ACCOUNT
Starcks reserves the right to suspend and/or cancel – upon timely notification – the Account of the User and/or Token Holder in the event that they engage in conduct that is harmful and contrary to the policies and rules adopted by the Platform, as well as to the spirit, objectives and purposes of the Service offered by the Company, as described below.
Starcks may decide, at its sole discretion, to suspend the User's and Token Holder's Account (the "Account Suspension") in the event that the following events occur:
- the User and/or Token Holder violates any of the obligations set out in Article 3 above, which they have accepted and signed;
- the User and/or Token Holder violates the regulations governing any Referral Programmes activated by Starcks on the Platform;
- the documents provided by the User or Token Holder during the Account activation and completion of the KYC and AML procedures have expired and/or are about to expire.
Starcks may, at its sole discretion, proceed to cancel the User's and Token Holder's Account in the event of the following events:
- the User and/or Token Holder engages in fraudulent activities that are detrimental to the interests and purposes pursued by the Company and damaging to the brand and the Platform;
- in the event of Account Suspension, the User has not responded to the Company regarding the requested information within 15 (fifteen) days of receiving the communication.
Art. 9 – KYC and AML
The Company declares that it has adopted strict KYC procedures, all designed in accordance with current market practices and in compliance with national (Legislative Decree No. 231 of 21 November 2007 and subsequent updates) and EU legislation, in order to verify the real identity of its Users and those intending to purchase the Tokens issued on the Platform, in order to protect Users and the Company itself from criminal activities such as money laundering and terrorist financing.
The User is aware that, despite accepting these General Terms and Conditions of Service, they will only be able to operate on the Platform and access certain services - such as the possibility of purchasing Tokens - after the identification procedure has been completed and has been successful.
In light of the provisions of Art. 7.1, the User hereby undertakes to provide the personal documents requested by the Platform in the execution of the KYC & AML process, which they guarantee to be complete, truthful and adequate.
The Company shall not, under any circumstances, be held liable for any use in the KYC & AML process by the User of documents, as referred to in the previous point, which prove to be false or altered.
The Company reserves the right, in any case, to comply with legal obligations by reporting any suspicious activities to the competent authorities.
The Company ensures that, at the time of acceptance of these General Terms and Conditions by the User, it does not have any relationships, conduct business or intend to do so in the future with persons who (i) refuse to provide the requested information or documentation, (ii) are legal entities whose shareholding/control structure cannot be determined, (iii) are included in any PEP list or have a criminal record relating to money laundering or terrorist financing, (iv) may, based on available information, be involved in criminal activities, (v) conduct business in which the activity, related income and funds employed therein are not reasonably verifiable.
All personal data provided by the User when registering on the Platform will be processed and used by the Company in compliance with anti-money laundering and privacy regulations and, in general, with the confidentiality and security rules provided for by law, as indicated in the Company's policies, which are always available on the Platform.
Art. 10 – PROCESSING OF PERSONAL DATA
Starcks undertakes to the User to process their personal data, received from them in connection with and in execution of the Service, in compliance with the provisions of current legislation on the protection of personal data, such as Regulation (EU) 2016/679 (the so-called "GDPR") and Legislative Decree no. 196 of 30 June 2003.
The User's personal data provided in the performance of the Service will be stored and retained in compliance with the technical and organisational measures provided for in Article 32 of the GDPR.
The User declares that they have read and accepted - by ticking the relevant box when registering on the Platform - the Information Notice on the Processing of Personal Data on the Website and on the App.
Art. 11 – INTELLECTUAL PROPERTY
All content on the Website, App and Platform, as well as the trademarks, logos and other distinctive signs used by the Company in its business, the economic rights to use the name transferred by the Stars and the content of the Whitepaper available on the Platform are to be considered the exclusive property of Starcks S.r.l. and, as far as necessary and possible, protected by the relevant intellectual property rights to be recognised as belonging to the same.
Accordingly, the User is aware that no one outside the Company is authorised to use the content of the Website, the Platform, the App or the Whitepaper, as well as the content of any electronic or written publication, texts, graphics, photographs, names, designs, logos and trademarks owned by Starcks S.r.l. and the naming rights transferred to it, without its prior written consent.
In the event of a breach of the provisions of the previous paragraph, the Company reserves the right to take legal action to protect its rights.
Any other trademarks or distinctive signs owned by third parties that may appear on the Platform or on any other document owned by Starcks are the property of their respective owners, from whom the Company has received specific authorisation and/or licence for use.
All textual, visual and functional content of the Starcks platform, as well as the source code, logos and distinctive signs, are the exclusive property of Starcks S.r.l. The names of players and their performance statistics are information provided by the Data Provider and are used in accordance with the licence granted by Sportmonks.
Official logos, crests, photographs and other visual elements relating to football teams or leagues remain protected by copyright and image rights. These elements are not reproduced on the platform, except in generic and stylised graphic form.
The misuse or unauthorised reproduction of the platform's content or data obtained through it constitutes a violation of intellectual property rights and will result in account suspension and possible legal action.
Art. 12 – REFERRAL PROGRAMMES, BONUSES AND REWARDS
Starcks periodically reserves the right to activate referral marketing programmes (the "Referral Programmes") in order to promote its business, the Starcks brand, and the use of the Platform and the Service to new potential Users through sharing activities carried out by already registered and active Users.
By participating in the Referral Programmes, Users may be entitled to receive discounts, vouchers or other types of rewards offered by the Company.
The User acknowledges and agrees that access, accrual, and maintenance of any bonus, promotional incentive, and/or reward resulting from referral programs and bonuses made available by the Platform (hereinafter, collectively, the "Bonuses") are subject to the actual use of the deposited funds in the game offered on the Platform, through the purchase and use of Star Tokens and Star Player Tokens.
For the avoidance of doubt, the provisions of this Article relating to Bonuses apply to all Bonuses granted by the Company, including those deriving from the Daily Streak and from any other promotional initiative made available on the Platform, and are not limited to those deriving from the Referral Programmes. Accordingly, the prohibition of bonus hunting and the related powers of the Company provided for in this Article apply to all such Bonuses.
The User is expressly prohibited from engaging in conduct that could be classified as "bonus hunting," meaning—by way of example and not limited to—conduct aimed exclusively or predominantly at obtaining, exploiting, or multiplying Bonuses without the effective and fair use of the Platform's gaming services, including merely formal or symbolic deposit and use transactions, including through evasive mechanisms or circumventing the rules of the promotions or referral program.
In the event of proven or even reasonably suspected bonus hunting by the User, the Company shall have the right, at its sole discretion:
- to revoke, in whole or in part, any Bonuses already awarded to the User,
- to cancel or reverse any financial benefits directly resulting from the use of the revoked Bonuses,
- without prejudice to the Company's right to take further measures as set forth in the Platform's General Terms and Conditions (including, where applicable, suspension or termination of the account).
The specific conditions of each Referral Programme, such as its duration, the rewards offered, and the methods of participation and obtaining rewards, will be indicated each time in the regulations for each individual Referral Programme activated from time to time, as drafted and made available to Users on the Platform for their consultation. In any case, the validity of this clause remains understood in order to protect the correct use of the Platform.
Art. 12.1 – DAILY STREAK
Starcks may make available on the Platform a consecutive-access mechanic (the "Daily Streak"), whereby Users who access the Platform on consecutive days may obtain a reward in Credits. The amount of the reward, the frequency of accrual, the access conditions and any progressions are indicated in the related rules published on the Platform and may be amended from time to time.
Credits obtained through the Daily Streak constitute Bonuses within the meaning of Art. 12 and are therefore subject to all the provisions set out therein, including the requirement of effective and fair use of the Platform's gaming services, through the purchase and use of Star Tokens and Star Player Tokens.
Participation in the Daily Streak is reserved for natural persons holding a single Account who have completed the KYC & AML procedures required by the Platform. The User is expressly prohibited from creating, holding or using more than one Account, or from using Accounts registered to third parties, in order to obtain, exploit or multiply the rewards deriving from the Daily Streak.
In the event of a proven or reasonably suspected breach of the preceding paragraph, or of conduct qualifying as bonus hunting, the Company shall have the right, at its sole discretion:
- to revoke, in whole or in part, the rewards already granted to the User through the Daily Streak;
- to cancel or reverse any benefit directly deriving from the use of the revoked rewards;
- without prejudice to the Company's right to adopt further measures provided for by these Terms and Conditions, including, where applicable, the suspension or cancellation of the Account.
The Company reserves the right, at its sole discretion and at any time, to modify, suspend, interrupt or permanently discontinue the Daily Streak, as well as to vary the nature, amount, frequency and conditions of the related rewards. The User acknowledges and agrees that participation in the Daily Streak does not generate any vested right to receive rewards, present or future, and that no claim may be brought against the Company in this respect.
The Company shall not be held liable for the loss or interruption of a sequence of consecutive accesses resulting from service interruptions, technical malfunctions, force majeure or any other event beyond its control, in accordance with the provisions of Art. 7.
Art. 12.2 – BADGES
Starcks may award Users digital elements of a purely aesthetic nature (the "Badges"), displayed on the User's profile in recognition of the activities carried out on the Platform.
Badges do not constitute Digital Assets, have no economic value and are not, nor may they be, converted into Credits, Star Tokens, Star Player Tokens, money or any other benefit of an economic nature.
Badges are strictly personal and non-transferable. They may not be sold, assigned, exchanged or otherwise transferred between Users, within or outside the Platform, and confer no advantage, priority or benefit of any kind in the games offered on the Platform.
The Company reserves the right, at its sole discretion and at any time, to introduce, modify, replace, withdraw or discontinue Badges, without the User being entitled to bring any claim against it.
Art. 13 – DURATION
These General Terms and Conditions shall take effect from the date of acceptance – by ticking the appropriate box when registering on the Platform – and shall remain in force for the entire duration of your relationship with the Platform and, therefore, until the closure of your Personal Area and Wallet.
Art. 14 – JURISDICTION
Any dispute arising between the Parties as a result of or in connection with these General Terms and Conditions of Service shall be referred to the exclusive jurisdiction of the Court of Rome, to the exclusion of any other concurrent jurisdiction.
For the purposes of settling any dispute arising from these Terms and Conditions, the User may alternatively refer to the Online Dispute Resolution (ODR) platform, managed by the European Commission, with the aim of facilitating the out-of-court settlement of disputes between consumers and professionals. This method of dispute resolution can be accessed via the link http://ec.europa.eu/consumers/odr/.
This Agreement is governed by and shall be interpreted in accordance with Italian law.
Art. 15 – AMENDMENTS AND ADDITIONS
Starcks reserves the right, at any time, to modify, supplement and/or cancel, in whole or in part, the Services, the Annexes, the company policies, these Terms and Conditions and any content and/or document ancillary thereto, in order to offer new products or services on the Platform or to adapt to market requirements and/or legal and regulatory provisions.
In the above case, Starcks undertakes to notify Users of contractual changes by sending a specific notice on the Platform's homepage (including through the use of specific banners and, where applicable, through newsletters) and publishing the new documentation and updated Terms and Conditions on the relevant page of the Platform.
Once the communication regarding the updates to these Terms and Conditions has been received, the User undertakes to regularly check the Terms and Conditions as well as its Annexes, and expressly agrees that their use of the Starcks Service, following communication of the changes to the documentation, constitutes an unequivocal expression of acceptance of the same.
If the User does not intend to accept the changes made to these Terms and Conditions or the Annexes, they shall have the right at any time to request the cancellation of their Account by submitting a request from their Personal Area on the Platform.
From the moment the cancellation request is submitted, the User will have the option to contact the Platform's customer service (the "Customer Care") to request the reactivation of the account within 30 (thirty) days. After 30 days, it will no longer be possible for the User to reactivate their Account, and any accumulated Star Credits will be lost.
In the event of regulatory or contractual changes relating to the use of sports data or licences granted by Sportmonks, Starcks will promptly update these Terms and Conditions, ensuring transparency and continuity of service to users.
Art. 16 – COMMUNICATIONS
Any communication following acceptance of these Terms and Conditions must be made in writing and shall be deemed to have been effectively and validly executed at the email address support@starcks.io
