Referral policy

1. Promoting entity

Starcks S.r.l. (hereinafter “Starcks” or the “Promoting Company”) with registered office in Via Vittorio Bachelet 12, Tax Code and VAT No. 16566161002.

2. Type and name

Free promotion with an instant reward, called “Bring a friend or referral policy”.
Participation in the initiative is free of charge.
Participation in this Operation implies full acceptance by Users of the provisions of these Rules.
The Promoting Company assumes no liability and may proceed with the immediate ban of the account in the event that the Users involved fail to comply with the requirements of Article 8 below.

3. Territorial scope

The initiative governed by these Rules takes place throughout the European territory, on the website www.starcks.io (the “Platform”).

4. Duration and subject matter

The promotion is valid on an ongoing basis and is aimed at encouraging the opening of accounts through the issue of certain digital assets usable exclusively within the platform to purchase the STPs credited to the beneficiary's wallet.

5. Eligible participants

The Prize Operation is aimed at all natural persons who, throughout the duration of the initiative, register on the Platform and have activated their user profile (the “Users”).

6. Description of the operation

The promotional initiative is aimed exclusively at Users of the Platform, allowing them to accrue the right to receive Star Tokens (ST), in the quantities and manner illustrated below, in the event that a new person registers on www.starcks.io using the alphanumeric code assigned to the User, shown in the reserved area (the “Personal Profile”) on the Platform (the “Referral Code”) and proceeds to purchase the Star Tokens or Star Player Tokens available therein.
The quantities and manner in which the STs will be granted are set out by Starcks in Article 8 of these Rules.

7. Communication and advertising of the operation

This Operation will be advertised via newsletter, on the website www.starcks.io and on Starcks' social networks.
Advertising messages will be consistent with these rules.

8. How the operation works

Starcks invites Users to take part in the promotion by inviting persons not previously registered to sign up on the Platform and make a purchase of Star Tokens there, under the following terms:

• the User, upon request, will receive from Starcks a Referral Code, which will be assigned to them and displayed in a dedicated box within their Personal Profile, to be sent to third parties not yet registered (the “Friends”) so that they may proceed to register on the Platform;
• the Friend must register on the Platform by entering the Referral Code in the dedicated box within the registration form and must purchase a number of Star Tokens equal to at least 20 euros (the “Purchase”);
• once the Purchase has been finalised by the Friend, Starcks will immediately grant the latter and the User whose Referral Code was used a variable number of Star Tokens corresponding to € 30.00 (thirty) each, which will be loaded onto each person's personal Wallet – available on the website www.stracks.io – immediately or, at the latest, within 24 hours;
• in the dedicated “Referrers” box in the User's Personal Profile, which shows the list of Friends who have used the Referral Code, it will be possible to view the Friend's name or an alphanumeric code associated with them.

Please note that the User and the Friend will each be granted a number of Tokens equal to € 30.00 (thirty) regardless of the value of the Purchase made.

The Referral Code is to be understood as reusable by the User and their Friends a limited number of times during the period of validity of the Operation in question, allowing the User to invite a maximum of 20 (twenty) interested Friends to register on the Platform.

Once the maximum number of 20 (twenty) uses of the User's Referral Code has been reached, the User will not accrue any right to receive the reward offered by Starcks for any Friend who subsequently uses the Referral.

Any activity carried out by the User that is classified as improper (for example, the activation of fake accounts or any subsequent activity aimed at invalidating the Purchase) will cause the User and the Friend to lose the right to be granted the Reward and may lead to the account being banned.

From the moment the gift is received and for the following 6 months, the Tokens received as a reward may not be monetised, i.e. converted into money, by the User and/or the Friend in a single transaction.

9. Delivery method

Each promotion consists of a variable quantity of Star Tokens, issued on the website www.starcks.io by the Promoting Company.

The Reward will be granted to each User and Friend for whom the conditions set out in Article 8 above are met.

The rewards may not in any way be converted into money at the time they are granted and delivered, as they are vouchers for taking part in the platform's initiatives.

Starcks reserves the possibility and the right to vary the quantity or type of goods forming the Reward and, in this case, undertakes to adequately and promptly communicate such changes to Users.

The number of Star Tokens making up the Promotion will be determined according to their sale price applied on the actual date on which the right to receive the Reward accrues.

10. Duration of the Referral Code and of the reward

The Reward will be granted to the User and the Friend only if the latter, within the deadline set for this Operation, has not only registered on the Platform but has also made the Purchase.

If, within that deadline, the Referral Code has been used at registration on starcks.io but the Friend has not made the Purchase, neither the Friend nor the User will accrue any right to receive the Reward.

Upon expiry of the Operation, the Referral Code will no longer be valid, regardless of when it was sent to the Friend to proceed with registration on the Platform.

11. Guarantee of the rewards

Given that the delivery of the Rewards takes place at the same time as the required Purchase and the accrual of the right to receive the reward itself, Starcks has deemed it unnecessary to provide any guarantee, as expressly provided for by Article 7(1)(b) of D.P.R. 430/2001.

13. Processing of personal data

The Promoting Company declares that participation in this Prize Operation entails the processing of participants' personal data, which will take place in compliance with Regulation (EU) 679/2016 (the “GDPR”), Legislative Decree 196/2003 and subsequent amendments, for purposes strictly connected with the Operation itself and for a period of time proportionate thereto.

The processing of personal data will be carried out with the aid of electronic tools. The data controller and processor is Starcks S.r.l., with registered office in Via Vittorio Bachelet 12, Rome (RM), which ensures that data processing will be carried out using tools and procedures suitable to guarantee the security and confidentiality of participants. Participants may exercise, at any time, the rights provided for by Regulation (EU) 679/2016, including, among others, the right to obtain confirmation of the origin and of the existence or otherwise of personal data concerning them, their updating, rectification or integration, the right to object to the processing of such data, as well as to request the deletion of the data provided, by writing to or contacting the Promoting Company at support@starcks.io.
